The European Commission’s “Mobility Package” is an initiative for changing and extending EU road transport rules. It intends to better balance the objectives of safety, social fairness, sustainability and economy for the European road transport system.
 
Among the new set of rules, three legal acts stand out as problematic to the transport sector: drivers' rest periods, driver posting and cabotage within another EU country with its requirement to return the vehicle to its country of registration every 8 weeks.

  • Return of the vehicle to the State of registration.
  • Introduction of a break between cabotage operations.

MAGDALENA BARTNIK - JDP Drapała & Partners, Associate (Poland)

Advocate with the Transaction Team. He specializes in conducting court proceedings, in particular proceedings associated with corporate disputes, M&A transactions and cross-border trading. He has represented clients in proceedings regarding liability for breach of representations and warranties given with respect to the sale of enterprises and in complicated corporate disputes over validity of resolutions on election of management board members, he also represented foreign investors in disputes arising from breach of a shareholders agreement. He also specializes in disputes related to property recovery and the enforcement of difficult debts - the so-called „asset tracing & recovery matters”. He has also experience in providing transaction advice to foreign entities carrying out investment projects in Poland.
